What Do I Do Next? Addressing Claims of Sexual Harassment

A common issue that I see in the industry concerns claims of sexual harassment and how to handle them, whether it be by drivers operating as a team or drivers and their trainers. Companies should be counseled to ensure the proper steps are taken in response to a claim. For example, consider the following:

  • What if the claim arises and the trainer and driver are out on the road?
  • What if the company does not have a human resources department, who should handle the investigation?
  • What if the allegations rise to the level of criminal conduct?
  • What if the claim involves an officer of the company?
  • Who should be interviewed first, the claimant or the alleged aggressor?
  • Does the company have a policy against sexual harassment and what progressive disciplinary policy should be followed depending upon the findings of the investigation?
  • Is there insurance available to that can help the company investigate claims?
